On 6th April 2007 new government legislation was brought in, making it mandatory to safeguard all tenants' deposits in an approved scheme. 

The Tenancy Deposit Scheme (TDS) means that any disputes regarding deposits at the end of a tenancy can be brought to an independent adjudicator.  

Dispute arbitration is evidence based, and The Dispute Service reports that the first 100 disputes adjudicated by the Tenancy Deposit Scheme for Regulated Agents clearly shows the need for proper inventory and condition reports.  Their case studies time and again state that landlords’ proposed deposit deductions could not be substantiated because of a lack of independently compiled Check In and Check Out reports or in some cases no reports at all.

survey by Alliance and Leicester Mortgage found that some of the most common grievances that cause landlords to deduct from tenants’ deposits are for property damage (26% of landlords), cleaning costs (22%) and furniture damage (21%).

The only real way to prove that these deductions are necessary is to have detailed, independent Check Ins and Check Outs carried out at the beginning and end of every tenancy.
